Bearmach Ltd Web Access Agreement

By using this system, you agree to the terms of this Web Access Agreement. Access is provided to you solely in connection with that portion of your business involving the purchase, sale or resale of products (including allied products) or services, or the provision of services in connection with such products, from or to your supplier or customer for whom Bearmach Ltd, is providing this Web Access service. As the screens and documentation are copyrighted, and in consideration for your right to access, you agree not to copy or reproduce any screens or documentation or use any trademark without the prior written consent of the copyright or trademark owner. The system accessed contains confidential and proprietary information of its owners, Bearmach Ltd, and you agree not to disclose any accessed information to third parties.

BY USING THIS SYSTEM, YOU ACKNOWLEDGE AND AGREE THAT IN NO EVENT SHALL BEARMACH Ltd BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS, COST OR DAMAGE RESULTING FROM YOUR ACCESS, INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS, AND DAMAGES WHICH CAN RESULT FROM ACCESS TO THIS SYSTEM), EVEN IF BEARMACH Ltd HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND, AS A CONDITION TO ACCESSING THIS SYSTEM, YOU EXPRESSLY WAIVE ANY CLAIM YOU MAY HAVE AGAINST BEARMACH Ltd ARISING FROM SUCH ACCESS. YOU ACKNOWLEDGE THAT THERE IS NO EXPRESS OR IMPLIED WARRANTY FROM BEARMACH Ltd TO YOU, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, OR OF NON-INFRINGEMENT.

APART FROM THE PREVIOUS PARAGRAPH, YOU FURTHER ACKNOWLEDGE AND AGREE THAT IN NO EVENT SHALL BEARMACH Ltd BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS, COST OR DAMAGE RESULTING FROM YOUR ACCESS, INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS, AND DAMAGES WHICH CAN RESULT FROM ACCESS TO THIS SYSTEM), EVEN IF BEARMACH Ltd HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND, AS A CONDITION TO ACCESSING THIS SYSTEM, YOU EXPRESSLY WAIVE ANY CLAIM YOU MAY HAVE AGAINST BEARMACH Ltd ARISING FROM SUCH ACCESS. YOU ACKNOWLEDGE THAT THERE IS NO EXPRESS OR IMPLIED WARRANTY FROM BEARMACH Ltd TO YOU, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, OR OF NON-INFRINGEMENT.
